Frison v. WMC Mortgage Corp., 2011 WL 4571753 (S.D. Cal. September 30, 2011)

Plaintiff asserted claims against our client for violations of 12 U.S.C. §2605 (RESPA), 15 U.S.C. §1601, et seq. (TILA), and Business and Professions Code §17200; negligent misrepresentation, fraud, rescission, and other common law claims. We filed a motion to dismiss and secured our client’s dismissal. 

Bernardo v. New Century Mortgage Corp., 2010 WL 1947663 (S.D. Cal. May 13, 2010)

Plaintiff asserted causes of action against our client for intentional misrepresentation, constructive fraud, breach of covenant of good faith and fair dealing, quiet title, accounting, violation of TILA, RESPA, Business and Professions Code §17200, and Civil Code §§1632(b), 2923.5, and 2923.6. We filed a motion to dismiss which was granted and the action was dismissed.

Benham v. American Servicing Co., 2010 WL 1525187 (N.D. Cal. April 15, 2010)

Plaintiff brought claims against our client for fraud, breach of fiduciary duty, breach of contract, or, in the alternative, rescission of contract, breach of the implied covenant of good faith and fair dealing, negligence, wrongful foreclosure, and violation of Civil Code §1788, et seq., Business and Professions Code §17200, et seq., 12 U.S.C. §26045, et seq. (RESPA), and 15 U.S.C. §1601, et seq. (TILA). We filed a motion to dismiss and secured our client’s dismissal. 

Garavito v. GE Money Bank, 2010 WL 744284 (S.D. Cal. March 2, 2010)

Plaintiff asserted claims against our client for violations of 12 U.S.C. §2605 (RESPA), 15 U.S.C. §1601, et seq. (TILA), Civil Code §1632, et seq., and Business and Professions Code §17200; negligent misrepresentation, fraud, rescission, quasi contract, and determination of validity of lien. We filed a motion to dismiss and secured our client’s dismissal. 

Sanchez v. U.S. Bancorp, 2009 WL 3157486 (S.D. Cal. September 25, 2009)

Plaintiff asserted claims against our client for breach of contract, breach of covenant of good faith and fair dealing, fraud, violation of statute, quiet title, and declaratory relief. We filed a motion to dismiss and secured our client’s dismissal. 

Forbes v. Litton Loan Servicing, LP, 2011 WL 4348282 (Cal.App. 4 Dist. September 19, 2011)

Plaintiff brought claims against our client  for violation of Business and Professions Code §17200 and Civil Code §§1572, 2923.5 and 2923.6; fraud, and intentional misrepresentation. We filed a demurrer to the complaint, which was granted. Plaintiff filed an appeal with the Court of Appeal for the Fourth Appellate District. We prevailed following oral argument before the Appellate Court and the appeal was dismissed.
